Do both parties have to be in agreement to have joint custody in CA?

I currently have primary custody of our 8 and 6 year old. The ex has visitation. He seems to believe that joint custody of 50% time is "inevitable". Is that true? Three years ago, at our last court/mediation go around, I believe the court apppointed mediator said that both parents have to be in agreement before 50/50 time is recommended.
