First of all your sister cannot give either of you power of attorney,power of attorney is given to someone in the family to take care of a person in the family that is unable to make decitions on their own do to an illness or injury making them incapiable to do so for their self. Your sister can give you consent to file for legal guardianship of your niece. It needs to be a family member. This has to go though the court it is not legal for your sister to just sign a statement giving the rights of her child to anyone. You need to talk to her and ask her to do this.
