Emergency Custody

My kids live with me in NC and I have full physical custody. I am due to deploy in Jan. My ex wife lives in TX and is threatening to get a lawyer within the next few weeks and have the kids with her by Christmas. Our divorce/custody was filed and judgment received in CA. As much as we want to , we are not able to transfer the case to NC as we have not been residents in this state long enough. What state would she be trying to apply to? CA, as that is where the original decision was made? TX, because that is where she lives? Would she be able to get an emergency custody hearing within the next six weeks? While I am deployed, my children will be staying with my current wife in our home.

I would check with an attorney and see about delaying any action through the court until you return

I would check with your JAG office at your base or installation. You can get help for those sorts of things. Also, there are Family Readiness Support groups within a number of states. Which state do you live in.

We live in NC. However we have been told that JAG does not handle custody issues.
