Established Temporary Child Resident But not Through The Court

I signed a notarized letter stating that my sons father had LEGAL FULL TEMP CUSTODY of my son in 2006. Well, my son had been living with his father since he was a baby. I gave him that signed paper b/c he was taking care of him and his name was not on the birth certificate. I took my son back about 4 months ago and I switched all my son paper work at the school over to my name and I took his father off. I want to know since I signed that paper can he take unenroll my son out of the school that he intitally enrolled him in and if he can keep my son until we go to court since I did sign that paper giving him all Legal Rights?

Unfortunately, unless you get custody paperwork that counter that, it sounds like he can take him. Try and get everything in as soon as you can to get that changed.

If there is no other documentation or court filings, then even a non-court notarized agreement between the two of you would probably hold up. If you are really concerned you may want to talk to a lawyer to see what your quickest options would be to change the agreement that you had.
