Father has primary residential custody with joint custody between father & mother. Mom has no job and lives 5 hrs away from child. Who does driving for mom's visitation? Mom is also 4 mnths behind on child support.How will judge rule transportation?

My son's mom lives 5 hrs away from my son and my family & I. We had a temp visitation arrangement for 6 mnths that was ordered back in Oct. 2006.We agreed that she would have my son from 10 a.m. to 6 p.m. the 1st Sat. of every month and the 3rd weekend of every month I would have to drive & pick up my son from his mom's sisters house which is 1 1/2 hrs away from me.Mediation agreement also states this will be for 6 months for consisenticy and for mom to complete her original tasks ordered in our final order back in Sept. 2005. She was supposed to have her own car & place to live.She has done neither. She now has another baby with a man she is not with & does not have a job,house,phone or a car.I also have a change in income, I am in Real estste. I cannot afford to take my son to se

She's breaking the agreement then, so that's in your favor. A judge will allow her visitation time, but she should pay for half of the driving expenses. You shouldn't be forced to pay for all driving expenses.

Since she has a new baby, I would imagine a judge would want her to take care of her newborn first. How old is your child?

My step son is 9 yrs and my husband and I have a 1 yr old. BM baby is about 4 months old
