FINDING PATERNITY ON BABY GIRL MARTIN AND GETTING CUSTODY

LEGAL PAPERS CAME NAMING MY BROTHER AS FATHER OF A 14 MONTH GIRL WHOSE MOTHER IS IN JAIL AND GAVE UP HER RIGHTS.
BABY MARTIN HAS BEEN IN FOSTER CARE SINCE BIRTH. SHE IS IN
NORTH CAROLINA AND HE LIVES IN GEORGIA. HOW DO WE GO ABOUT FINDING PATERNITY AND IF IT'S HIS , HOW DO WE GO ABOUT GETTING CUSTODY? HE HAS THIRTY DAYS IN WHICH TO ANSWER TO
THE PAPERS HE RECEIVED. DO WE HAVE TO GET A LAWYER IN NORTH CAROLINA OR DO WE GET ONE IN GEORGIA. WE ARE A CLOSE KNIT FAMILY( IF HE IS THE FATHER AND HE WANTS TO KNOW) WE WANT THE CHILD WITH HER REAL FAMILY. THE STATE IS TRYING TO TAKE AWAY HIS RIGHTS. HE REALLY DIDN'T KNOW ANYTHING ABOUT THIS BABY UNTIL NOW

Your brother needs to make a decision as to whether or not he can provide for the child, it's a very big commitment. Is he going to take care of the child himself or ask your parents to help? A 14 month old needs a lot of care.

If you decide to try and get custody, you'll need to get a lawyer to fight for you. Call one in NC first to see if they can help; sometimes you can do court proceedings like this over the phone. Good luck.

I would first contact child and family services in the county that the child is now being fostered in and let them know that your brother is willing to take a paternity test to determine if he is the father, and if so, then he will be seeking custody. Contact an attorney in your area and answer the petition that you received before the 30 days expire..I would think that an attorney in North Carolina would be more appropriate for further action
due to location and travel expenses that would occur if a Georgia attorney had the case. Also, North Carolina attorney would know more about specific laws to that state and could possibly attend court dates that may come soon before your brother could get there.
