Getting sole custody from my abusive ex-husband

At what age can children have a voice in NY as to who they wish to live with. The children are 13 1/2 and 11 and their father an abusive policeman, who have managed to get 3 CPS cases unfounded (all called by unknown neighbors I believe). He is suing me for sole custody based on parental alienation (which is false). The children have been with me for 1 1/2 years and see him once a week under supervised visitation. He doesn't attend any school functions, etc., but ants for me to suffer--therefore is sung my for sole custody. Please advise. Thanks

Abusers are also control freaks and his way of continuing to control you would be gaining custody of your kids, but if he is now only getting supervised visits, I don't know how he thinks that he will get sole custody!! Your kids are old enough to speak to the judge themselves and depending on their maturity, their wishes will weigh heavily on the judges decision. I was married to one of these too, and its just an ongoing battle with them because they won't stop trying to do everything they can to hurt you, even if it involves your kids..Good Luck and hang in there...

I hate controlling men. and being a police officer makes him think he owns the world anyway. your kids are old enough to speak for themselves, and if he abused you, there's always a chance he could abuse your kids. (i'm assuming that's why he has supervised visits) he'll never get sole custody, that would just be dumb on the judge's part.
