Grandparent obtaining custody of 9 year old?

I have helped raise my granddaughter, Makayla, for the past 9 years. My daughter was arrested on drug charges and is on probation (which she just violated due to testing postive for a drug. She lost her job because of a drug arrest 2 years ago. She had to sell her house and can barely keep a job now. Today she is in court on the violation of probation charge. Makayla's father (my daughter was not married to him as he is married to someone else) has been on and off with a relationship with my granddaughter. She does not like him and does not want to live with him and his family. She is attached to me and said she wants to live with me (she is at my house several days a week). My question is does she have a right to live with me if that is what she wants? What are grandparent's rights when custody is still with a parent?

She can't decide until she's 18, a judge will consider her opinion when she turns 12 or 13 though. Your best option would be to ask for custody in court. Good luck, hope you work it out.

I agree with primetime. You would have to go to the courts and ask for custody there, otherwise, there isn't anything you can do until she is 18.

The only way to get custody of her 1 with your daughter signing over custody rights to you (either temp or pem) if you tell her temp until she gets her act together and tell her your only thinking of your grandaughters well being. or 2 proving her an unfit mother ( this is difficult and runs the risk of her biological father getting custody). Document everything ( how often she is at your house, what her relationship is with the father and his situation. Good Luck and I hope you the best.

The father would have first rights on having the daughter live with him.

but you could go to the courts and explain why your daughter should live with you and have a good shot.
