Grandparent temporary custody

My son has physical custody of his three children. he was n a serious accident and will be unable to care for the children for about 6 months. hs ex took the children supposedly to the movies and has not returned them . she says she is going to keep them, that at age 60 i am not fit to care for them, they are 11, 9, and 7. i feel it is best to keep things as normal for them as possible, i.e. home, school social activities etc. how can i get custody until he can do it himself. also if he says he wants them to stay with me does this hold any weight.

If she doesn't have physical custody and has not filed for temporary custody, you can file for temporary custody and take the children back. A judge would more than likely side with you if your solutions involves a less stressful situation for the children although she will still have her visitation as usual.
