Guardianship of grandchild

I have a 1yr old grandson that is living in a shelter with his mother, who has no jobe and is basically homeless, my son (the father) is living with a friend and has no job, they are not married and she will not let him see the baby, she is manic depressive and bi-polar, i am afraid for the baby, so how could i and can i try to get guardianship of the baby until the two of them can get settled.

In my state, there is temporary guardianship and permanent guardianship. Temporary is 60 days or less. Permenant guardianship is permanent.
In my state, I contacted the Probate office in my county. I had to fill out paperwork, we had to hire a guardian ad litem, she visited the child. We appeared in front of a judge, he asked questions, the guardian ad litem presented her findings. The judge granted permanent legal custody. The entire process takes 5 or so weeks, depending on how quick you fill out the paperwork and how busy the court is. Hope this helps!

My daughter is 20 years old, during her pregnancy she lived with us and we help her in any way we could. She is not married to the father of the baby. The baby is now 5 month old. Due to the constants fightings and dicussions with my younger daughter, and due to her laziness to find a job, or do something with her live.; she moved out to my son's apartment, who is recently married and doesn't have any furniture. My daughter is sleeping in an air mattress and the baby is sleeping in a comforter on the floor. Her constant unstability worries me. She says she will no stay too long at my son's apartment , she will try to ger her own apartment (I do not know how, withoug a job) She has been very unstable since 14 yearsold, and revelious kid. I fear for the baby mental stability. Can I request temporary custody of my grandchild until she gets stable?

Is your son on the childs birth certificate? It is hard to take a child away from the mother, the mother may be in a shelter but she is there with her baby, and that is not illegal, and it does not mean the mother is unfit, have you considered letting the mother and child come stay with you until the mom can get a job and on her feet. The father if he is on the childs birth derticicate then although tat does not automattically give him rights it does give him the right to file for custody, or visitation. I am going to get the laws in your state on grandparents rights and post it. So you can see if you have any legal rights. Plese gve us the state that you reside it please.
