Guardingship

I have a niece she does not want her kids . they have been living with my sister and i have a older sister that has been trying to get them and she is goin thru the dad to trying get to get the kids, she is wanting to get guradingship but she is afraid that if she does that then the father can get custody saying the mother was unfit for giving her kids to my sister that has been taking care of them, she is not sure what move to make

Well your sister is right,the father can file for custody if he finds out that the mother is signing to give anyone consent to file for guardianship. The father would have to be notifiled before the court would would grant the guardianship. That is required by law giving the other parent the right to ask for custody. The same rule would apply if he tried to do the same. If she can get both parents to sign then she would have a better chance of the court approving the guardianship.
