The way things are set up, whoever had the children for 50% of the year would be able to to claim them on their taxes for this year which it sounds like the father did, so he will be able to claim them this year unless he gives you permission to claim them.

HELP WITH TAX QUESTION
MY DAUGHTER AND HER HUSBAND ARE SEPERATED SINCE SEPTEMBER 2007, THEY HAVE 3 CHILDREN...WHICH MY HUSBAND AND I HAVE CUSTODY OF THEM SINCE SEPT 2007. NOW HOW WOULD THEY FILE THEIR TAXES THIS YEAR AS WELL HOW DO THEY DO THE CHILDREN? THE FATHER WORKS FULL TIME...AND THE MOTHER IS ON SSI AND SSD. AND BOTH MYSELF AND MY HUSBAND ARE ON SSD. SO CAN YOU HELP.
