How do you get physical custody when a parent is unable to take care of the kids but will not give them up because of money?

My husband has 3 kids from his ex-wife. Since their divorce, she has had 4 more kids and is currently unemployed. She doesn't have a stable home for them; she has lived with several relatives over the last year and shows no intent to improve her lifestyle. Over the last year, she has done nothing for them, We bought their school clothes, get their haircut, bought all of their Christmas and birthday gifts, and they always complain that when their child support check comes, she spends it on her boyfriend (who is married) and on the other kids she has. We have talked to lawyers here in GA and they have said that unless we can prove that the kids are being abused or neglected, they will not change the custody order. But I think that she is in violation of several terms of the custody agreement, i.e. providing a stable home, meeting their basic needs, Does anyone know of a lawyer who can get us this custody or have any advice? It breaks my heart to know that they are going to miss so many things in their life because their mother is too selfish to let them come leave with us and have a stable life. (we both work, have no kids, and have a home in which they can have their own room and live normal)

Your attorney is right unless you can prove that their is abuse there;s not alot you can do. Child custody is a battle that is not only costly but in alot of cases you never come out the winner. You can right down everything that your concerned about and if things get worse you can call CPS. If they do not see anything that concerns them your right back where you started. I think this is so hard and unfair but the court systems are sometimes messed up.
