How many times can the non-custodial parent not exercise his visitation rights before something can be done?

I have custody of my 3 children. My ex husband has not been exercising his visitation. I am having to live in a connecting county with him as long as he doesn't move. I want to know if that boundary can ever get lifted if he doesn't exercise his visitation, and he is always gone to another country.

If it is stated in a court order that your ex should have your child at certain times and does not abide by that order, it is a violation of the agreement. Therefore you have the right to return to court and file for an amendment; keeping in mind that the other party has the right to attend and argue his case.

You can file a motion with the court asking to be allowed to relocate to another part of your city, state, or out of state. You can tell the judge the father does not come see the kids and that makes a big difference, in the judges decition, if the non-custodial parent does not exercise his visitation order, there is know reason for you to have to be bound to stay. The father will have to notified of your intent to want to move, but if he does not see the children he probary won't try to stop you. You may want to just see if he would agree to let you move, if he would you could both agree and file that agreement with the court, then the court will allow the motion, you both would need aother parenting plan so the court can stipulate those visits in the new order. Forms for the non-contested change of relocation can be downloaded by going to your county court house, and the forms are free.
