How to get guardianship or custody of my 11 yr old grandson?

Help! I need to obtain information about protection for my grandson. Do I ask a lawyer about grandparent’s rights, guardianship, or custody. I have reason to believe that my grandson mother is an alcoholic and is mental and physically abusive to him. I have actually seen evidence of this myself. I have overheard conversations and seen him crying as she cusses him out on the phone. He is 11 yrs old and was suppose to visit for the whole summer. The other night she calls and wants to end his visit to two weeks and make him come home by Sunday. My grandson hates to even go home because of the abuse. What can I do? Do I contact anyone in particular to investigate her? Can I obtain temporary custodian or guardianship? I'm worried about his well-being, but I'm scared to bring any of this up with her before now, but I want to seek custody of him. However, for fear that she may take him away from us completely and not let us see him at all. This would affect him very much mentally (which would be an awful situation for him since she stays out all night many nights, is verbally abusive to him, and is an alcoholic). I have no hard evidence for this, only testimonies from family members that she has openly shared this info with. His father is incarcerated and unable to file any actions against her. Can I do something as a grandparent to prevent this abuse?

If you think it is an unfit home, you should probably call CPS (child protective services)

they will go in and determine if it is safe or not. if it is unsafe, you could get custody of him at that point, or another family member, or the dad

If you see any marks on the boy you should call CPS. I won't lie it is hard to prove a parent unfit and even when you do what usally happens is the court will order the parent into counciling. That may not get you your grandson but if she needs help and the court orders her to get it then that would give you some peace of mind. I am not saying that you can't file for legal guardianship I just an stating it is hard to get without the consent of the mother. If any of the family that is telling you what they are seeing will either write up and notize a statement or appear in court to testifly then your odds will be greater to get guardianship. However you must know if you were to get guardianship it would only be tempory,the court has to consider the wishes of the mother down the road if she were to shape her act up and want custody back. So you need to think about this but if she is abusive and hurting the boy that is not good he can also have a say in how he feels the judge will listen.
