How to resind an power of attorney and keep custody of my child

My husband passed away several years ago and I had two kids. I let one of my boys live with a freind for 16 monthes to relieve some of the tension that was caused following the death of their father. I wish to have both of my children living in one place, with myself (their biological mother) and the person that 1 child has lived with now is seeking custody of that child. She is of no relation to our family and has no grounds for gaining custody, (no abuse, neglect etc.) Can I simply reverse the power of attorney ?

A Power of Attorney is only good for the amount of time set forth on it or until you give written notice of its ending. Check with an attorney or para legal on this, but I am sure all you need to do is send a certified notarized letter ending the POA.

Here is some forms pertinent state by state...

This legal form may be used to revoke, cancel or rescind any previous power of attorney. To revoke or cancel any previously executed power of attorney form, simply download and fill in this form with the proper information. You should advise the agent and any organization or persons that have or would rely on the agent to exercise the powers granted previously. An acknowledgment from the agent is preferable, such as having the agent sign a receipt of acknowledgment or a copy of the form used to rescind his/her powers. In any event, in order to cancel you should do so in writing.

I went through something very similar recently. All you have to do is send her a certified letter stating that you are rescinding your consent of POA. Be sure to sign it and keep a copy with you just in case. That is all I had to do.
