How will an DWI affect custody?

My ex- husband received an DWI in September 2007. My son was in the vehicle at the time of the accident and was hospitalized for 5 days due to his injuries. How will this help my case in getting primary custody ? The case is being tried in Louisiana, Lafourche parish.

Clearly he is not responsible enough to care for the child. If this happened them he has probably dont it on more than one occasion.Also if he is able to retain custody then the child will only be in more danger. The child should be removed from his custody and he should be closely monitered when the child is with him to prevent further danger.

This will help your case,but to be honest the most that the court will do in regards to his visitations would be to order him into a rehab and supervised visits until he goes though the program. So I would file a motion to modifly your orignal order.
