I want full custody of my son?

The reason why I want full custody of my son is because he spends more time at me and my girlfriends house he doesn't ever want to go to his house he says he only wants me and my girlfriend. Everyone thinks he is my girlfriend son because she treats him like her own. My son is 3 years old and me and my girlfriend been together for 2 years and she loves my son she wants my son to grow up our son go to school together and she also rads to them she is a wonderful mother

What about his birth mother, is she willing to relinquish rights to your son? What's your current visitation schedule? Also, is the birth mother abusive?

My son is almost always with me he just never wants to go back. About his birth mother she just had a newborn baby boy and she does not want to give me custody. Me and my girlfriend asked we will keep him for the weekdays so we can put him and our son in preschool and she can have him for the weekends now that he stays over here all the time but no use she says no

As a mom I can't imagine having my child just taken away like that. If she doesn't want to give full custody and she's a fit mother, I don't think you have much of a chance. If you want to see him more, then talk with her about it, but taking a child away from the mother for no reason other than a 3-year-old crying because he has to leave is a little much.

He pretty much lives in my house she has him for like 2 days and she calls me to go pick up my son and besides that my son does not sound happy on the phone when he calls me and he comes to my house and never wants to go back there must be some type of reason

Unless you can prove a pattern of physical abuse, courts generally side with mothers. When the child is 12 or 13 he'll have a voice in court, but until that time courts won't listen to his opinion. Sorry, I know it's hard.
