If I leave my kids in care of my boyfriend, can my ex-husband show up and take the kids while I'm not there?

I live in Utah. My husband and I divorced many years ago. I have a boyfriend, and we have been living together with my kids for years. I have sole custody. My ex, in an attempt to throw his weight around, will sometimes show up and take the kids, while I'm still at work, and the kids are in the care of my boyfriend at the house we live in together. We called the sheriff to see if my boyfriend could refuse to let him take the kids while in his care, but we were told no. Is this right? I feel like I have no rights as their mother, cause everytime my ex wants to do something that screws up our lives, the law always seems to back him. Is there any way we can NOT let him take the kids if we don't feel that it's a good idea?

If you have sole custody, this means that you are the sole decision maker as to education, religion, health care and child care. If it is not his schedualed visitation then he cannot just show up and take your kids. I would suggest you conatact a family law attorney concerning this. If you can't afford one, try legal aid. You are obviously going to have to get the courts involved again.

As far as i know if you have "sole" custody he cant come and take them at all...does he have any visitation rights rewarded by the court? if so, he has to stick to them, and cant come and go as he wishes..he has absolutely no right to come into your home you share with someone else either!! if he appears again, call the police...but i would go to the police station and ask for a restraining order so he cant bother you..and if you do have a custody agreement through court, id petetion the court for him to follow that order or have it dismissed..there is just no way this is legal to do...contact someone before he does something worse than take them...

You have sole custody you can choose any person you like to babysit your kids while you are away.
