In california can a child of 16 choose which divorced parent to love with?

My wife and her ex-husband have a divorce agreement but no child custody agreement. They have been sharing custody with my wife having her daughter about 90% of the time and her ex having the 16 yr old child every other weekend. They have been divorced for about 10 yrs. Now the ex-husband wants the daughter to live with him about 70 miles away. The ex-husband has past legal issues (DUIs, and domestic violence). Can the daughter choose which parent to live with (we live in Calif.) or can we fight for custody in her best interest?

If there is no child custody agreement in place, it is up to them to decide. if they want the girl to pick who to live with, and both parents are ok with it. then let her live wherever.

but if she picsk the mom, and the dad throws a fit. or vice versa, and the other parent throws a fit. then it would be up to the courts to decide which parent she lives with. since at 70 miles away, you can't be with both 50/50 due to school reasons.
