In Colorado, what is the laws about taking children across state lines when there is a seperation.

My niece is wanting to leave her husband and they have two boys and she wants to go home to New Mexico. The boys are 12 and 13. Can she take the boys across state lines without getting in to trouble with law inforcement, before she gets the courts involved?

No Colorado is one of the tougest staes in trying to remove children out of state. She would need to get the consent of the father or she will have a kidnap charge bought against her. Even if she were to file for a divorce the court still would not allow her to move the kids out of stste he only hope is to get the father to agree.
