In need of help regarind my child

So... My ex and i were never married, and we had a seperation during our relationship i found out i was indeed pregnant before we decided to get back together, and we BOTH knew it was very likley that he was NOT the father. But he made the decision to sign the birth certificate, and the decleration of paternity ( we didnt take the test). Now my son is currently 26 months old, we seperated in october of 06. and had agreed upon terms in which our son would be with me wensday - sunday nights, and with him, we never went to court. it was just a mutual decison, i've since married and my husband is in the military and being transfered, my ex is telling me i need to sign paper so he can adopt my son, ( on paper legally he is the father), and i would just like to remove him from my life and my sons life, can i just go and request proof of paternity even thought the decleration was signed at the hospital, what can i do? ( just side note, the only reason i'm doing this he is a unfit father, and drinks heavily , and i dont feel safe leaving my child with him any longer) but he wants to take me to court as well, to keep me from moving, in doing so.. will they do a paternity test just because we were never married?..
