In the state of california when two parties have a child out of wedlock, do both parties get joint custody or do they have to go and file for custody.

I am a mother of a child who currently lives in the state of california, i reside in the state of south carolina, and i wanted to get information on my rights as a parent, my baby father is not letting me see my child and i was never served custody papers of me not having any right taken from me, and all i want is for the both of us to be able to be in the childs life, joint custody, what shall i do.
