Information in court

Okay, here's my question, I have a friend who is going to court for child support and custody in the upcomming months, and my problem is, is that she plans on telling the judge that the father does drugs, and my question is, as retaliation can he bring up any family members of hers or anyone else saying " well they do drugs too." to try and prevent her from custody? and if so what can happen to the people he mentions? will that be thrown out bc they have no real effect on the child in question? I would very much appreciate your information. thnks

This can get really messy. The judge can order that the parents take drug screening randomly to ensure that the child is being raised in a drug-free home. The danger here if both families are saying that they do drugs, they can both be ordered to be tested and if drugs are found in their systems, the child may be placed in foster care. Is that worth it - they'll have to decide.

What if its not a parent of the child, but a sibling of the mother who doesnt even live with her?

You can't use someone's family that does not live in the home as evidence to keep the child away. also if you have no proof and it is only hearsay they may be forced to do a drug screening or if the judge wants she could just tell you that this is not any concern for the child simply a way to keep him away. because this is hearsay the judge could also dismiss any hearsay...without proof. also if she lies in court and they find out she can be fined or worse have the child taken away...her record will be tarnished. she should only tell the truth in cases like this...its not worth the risk to lie.
