Is a court appearance required to change custody of a 9 year old, whose mother passed away, from grandamother to aunt

My step-daughter passed away 3 years ago. The maternal grand mother gained custody of her son and has recently had health problems. She now wants my 23 year old step-daughter to take custody. She claims all she has to do is sign a paper and have it notorized. My husband feels there is more to it. We want this to be legal. Pleaes advise. The father is also in favor of the custody change.
