Is there any help?

About 6 months ago my husband And I found out he had a son. This girl said that her baby was his, but only after claiming that it was this other boys(Justin)for a whole year. My husband paid for the DNA test, now she has taken us to court and is recieving $450.00 a month in child support, recently my husband has been layed off so do we still have to pay the full amount? She is also still recieving money from Justin's mother. We have not had the money to file for visitation, also so she will not let us see him. The childs last name is still that of the other boys. She lives with her parents who smoke weed around the boy, her father and his friends do cocaine and leave loaded weapons laying in his reach. Her mother is a drug addict and alchoholic. The girl sneeks out of her house & runs off with boys in the night & leaves the baby alone in the bed. Do we have a chance of getting custody? We have our own house, I have a good job at a law firm. We do not drink or do drugs and we could provide him with a safe environment.

Yes! I think that does not sound like a safe environment. You can get emergency custody if he is not safe - like being left alone with the drug addict grandma. Then try to get full custody if you want to assume the responsibility and possibly save the child.

Write a parenting plan with the best interest of the child. Allowing visitation, this establishes to the judge that your husband intends on excersising his legal visitation rights, and will move the court to his 'side' they can garnish wages as well. Use a child support calculator ( www.kids-first.com has one) and input new financial information, this may give you an idea of how much can be collected from him.

I think that you have a great chance too of getting custody. And this child is your husbands?

That girl doesn't sound very responsible at all, and I agree, your home would be better then hers to raise a child in.

I'm assuming the child is like 1-2 years old?
