Joint Custody

I have a 6 month old child. The father and I were never married and we broke up before I even found out I was pregnant. I began dating someone in the military and we got married recently. I live in Virginia and he is stationed in Kentucky. We haven't gone to court yet, but a pre-trial date has been set. The biological father already has a son who lives with the grandmother, and he barely sees but maybe 2 or 3 times a year. He's said that he is going to try and keep me in Virginia, even though I plan on moving with my husband when he gets home from Iraq. Can he keep me from leaving the state to live with my husband?

If you get full custody of the kid, I don't think he can keep you from leaving.
