Joint Custody

I recently got a divorce but I wasnt contesting anything in the divorce decree. I noticed that custody was an issue and we have joint custody but I'm the one with the primary physical custody. My question is if I decide to take my child on a trip what would happen if I violated the court papers? is it too late to get sole custody if I wasnt aware of the court dates?

It all depends on if you are leaving the state or going to be gone during the other parents visitation. If both parents agree then you will not be violating the papers. Make sure to document every agreement of any changes. If you are goingt o be gone during their visitation then you have 30 days to let them make up that time. You can file a petition for modification for sole custody but you'll need a lot of evidence as to why it needs changed to that. It's easy to go from sole to joint but hard to change from joint to sole.

Primary physical the child lives with you. Depends on exs days he gets for visitations. In order to get full custody will have to go back to court and get order modified. Only way you will be held in contempt would be if ex to you to court about it. Unless you already have a day schedule than you need to be there.
