When the father gets back from Iraq he then can file for custody of his child. Your power of attorney will not stand up in court as far as a custody battle. His ex did nothing illegal because your husband is in another country. You need to know that when your husband does come back he can get the custody. The courts will know he could not be there while in Iraq.
