Can i get full custody of my baby when the father has drug/alcohol problems?

I have a 10 month old son and i am thinking about getting a divorce. my husband has been abusing pills, alcohol, and drugs currently. my question is, once he finally does become sober (if he does) will he have the chance at getting joint custody? at what age? and also, if i had full custody, would there be a chance he would get full custody in the summers?

You just ned to file for sole custody and he will get visitaions and child support will then be ordered. If your concerned about his drinking you need to make the court aware he has a promblem and they may ordeer supervised visits until he gets help depending on the age of the child or children. Even if he does stop drinking he will not get custody rest assured. He cal always file for joint but unless he cleans up his act then he wouldn't get that.

Well you need to just take one step at a time. The issue at hand right now if that he is drinking and abusing pills,so you need to file for sole custody and you can ask the judge to stipulate that he have supervised visits because he is abusing pills and he drinks and you are concerned about thier saftey,in most cases the judge would order for him to get into a program for alcohol and drugs. If he does the program the court will look at his process and when he goes though the program and completes then he can ask the court for visitations. If you do not want him to have them for the whole summers you can have that stipulated,however the judge will allow him more visitation if he completes the program. If he were to choose later to try for joint custody that does not mean he would get it. As far as worring about him getting custody of the children relax it won't happen..

Yes you can if you can show he is an unfit parent. You will need to file for sole custody and go through the court system to take care of this matter.
