I am sorry to say but it will take more than the mother not having the same living arrangements that you feel that you have in order to fet the court to reverse custody to you. A mother is not denied having the right to keep her children because she does not have a car,unless you can prove the mother is unfit you will have a weak case if you file. Can I get joint physical custody as the father.
I currently have joint legal custody of both of my children. ages 11 and 3. My kids live about 10 miles from me. They live in a small 2 bedroom apartment with their mother and her husband. I live in a 3 bedroom house with my wife. I have better living arraingments and we have two cars. The mother of the kids does not have a car. Do i have a chance of getting joint physical custody?
