Can i get sole custody of my daughter although i live in another state?

My husband is divorcing me and asking for joint custody, my sisiter is petitioning for my rights in the joint custody with my husband. they all live in TX , i have signed a temp agreement for my daughter to stay with my sisiter until the final decision, because i live inTN, we have been to court once already, it is very hard to see the judge in Harris County family court, i do not have a lawyer, i dont believe i need one. my sister and my husband have kept my daughter away from me by sneaking around, telling me that my daughter is with my husband when she is really with my sisiter, or telling me that my husband resides at my sister's house to keep me from coming to pick her up. my mother and i are very confused and want to resolve this issue. i want sole custody of my daughter, i do not have any other injuctions regarding me or this matter, how will a Texas family court handle this case?

If you want sole custody, why did you sign a temp. agreement that she live with your sister? Wake up! She is not working for you if she is keeping your daughter from you! Sounds like sister and you ex are getting together and have stuck it to you by getting you to sign the temp agreement. If you had thought about it, you would have kept your daughter with you in TN, then all the court hearings would have been in your town, because your ex would have had to serve you there. I hate to say it, but you may have killed your chance at sole custody or maybe even joint custody just by signing the temp. agreement. Can I ask who wanted you to sign that? Was it the court? NEVER EVER SIGN SOMETHING UNTIL YOU KNOW WHAT IS GOING ON!

Your first mistake is signing anything giving your sister premission to keep your daughter until the court date. The paper you signed is not binding because it wasnot approved by the court. Your sister and husband are playing you. If you wanted sole custody of your child you would have the child in your care now. From what your saying I can give you some ideal about what their planning. If your husband is filing for divorce and he has the child in his care and goes to court he probarly intends to ask for sole custody. It sounds like he is just not wanting you to know where the child is so that he can buy some time until he goes to court. Even if you have know money if he is filing for the divorce you don't need any,all you have to do is go to the hearing. If you want sole custody I would sujest that you get your child back even if you have to take the police with you,she cannot hold that paper you signed against you. As of right now neither you nor your husband has custody. So as long as the child is with him and he files then he has a better chance of getting custody he can say you abandoned your child and show the courts the letter stating you left your child with your sister. The judge will look at that and that would not be good for your case. If you get the child back then he can't show the court that you put your child in your sisters care. You may be eligiable to recieve free legal services they go incom. However there are some cases they don't take so you need to call and find out. You need to think about this and make the right decition for you and your child,if you lose in court because you left your child in the care of a family member it won't be easy to try to regain custody at a later date.
