Can I give my in-laws joint custody?

My inlaws keep my daughter Mon-Fri during the time my husband and I work. we would therefore like to put her in the school district where they live. Can we petition the court for this option even if there is no divorce?

You and your husband can give consent allowing your inlaws to file for legal guardianship. This is probary the better way to go for the reasons that you have stated. With legal guardianship it is tempory,meaning it is given to the granparents until you file for custody of your daughter back. If you give them custody it is more premanent and harder to get back. So I would just talk to your husband and decide what is best for the both of you. If by some chance the grandparents decided not to want to give her back you would have a court battle with them having custody,but not with guardianship. i am sure that you both feel comforiable right now but you never know what might happen down the road.

The school system stated that legal guardianship is not enough, that it would have to be custody. Can we share custody like divorced parents do? I have no issues with my inlaws having partial custody (or even full custody but that leads to more issues such as health insurance, taxes etc)
