Can my boyfriend keep our child longer then a scheduled visit without legal documentation?

My boyfriend and I recently seperated and he moved 7 hours away with his family. It has been 1 1/2 months since he has left and now he wants to take our two year old son for a week 7 hours away. I have no legal documentation and am concerned that he may try and keep our son longer. What should I do if I can not get legal documents before he leaves?

You need to file for sole custody of your son. Until you do neither one of you have custody. I would file asap and then tell him that he can't take him right now.There is nothing he can do. When you file for custody visitations will be stipulated as well as an order for child support.

File for sole (not joint) custody, and by law he cannot take the child with him before the age of 3... I would advise you to be very very careful, if you let your son go with your ex, being that he is the biological father, he can file for sole custody where he lives now saying that he's the one that has always cared for him, and being that at the moment he would have possesion of the child it coulde get very ugly very quick and at best you would end up with joint custody, and at worst with just visitation.

Find a lawyer and if you cannot afford one, see if your state has a legal aid office.
