Can my EX move out of state with my two girls w/o me knowing?

Original court order in 2005 in Nj State. Order states joint custody but gives her permission to move to FL State by my permission cause originally was going to move their for a job as well. Job fell thru and couldnt leave my current job.

since then, I moved her back to NJ in 8/2009 and payed all expenses so kids to be closer to me. she since broke up with her boyfriend and she took off back to FL again after having a certified NJ mailing address and kids enrolled in a NJ state public school district. She stopped letting me see kids awhile ago and also when suppose to kept canceling. No contact recent and just found out klast nite she took off by a family member. Since she moved back to Nj do i have a valid rite to apply for immediate act for her to return them back to NJ.

I find that in the state of NJ the laws are much different from most other states in regards to custody, relocation ect. In NJ once a court grants custody it is final. I researced for you on what you might be able to do in regards to your ex moving out of state. Regardless as to whether she did move infact out of state for a job or something else, as long as there is a clause in the divorce order stating she can move then that is the final decition of the court, and the court of NJ holds juristriction over the custody order. My sujestion to you is to contact an attorney, there are plenty that offer free consutaion and it is worth going in to find out if there is something you might be able to do, if you cannot do anything about the ex moving then you can do something about her not allowing you to see the child(ren). You need to consider the cost and time that this will take, after talking with an attorney then you can decide if you want to prusue this further, personally I do not believe parents should put any clause in thier divorce, custody order, for this very reason, when parents make these decitions they always think short term, big mistake, always think long term, then this does not happen. I hope this works out for you.
