Can my ex move with Joint Custody?

My ex was laid off and wants to take a position with the same company in North Carolina so she can get her pension with the same company (she'd get pension benefits in 9 months). Can she just move? We have joint custody. There are many opportunities for employment close by here in Ft. Lauderdale, Boca, Miami. She could have chosen to look at this same postion with the old company in Orlando...but wants N. Carolina. I am very involved in their lives socially, educationally and have coached teams they are on. Please advise.

Usally when you get a divorce it is stipulated that neither parent can move out of state with the child or children. Legally she would have to file a motion with the court to modifly the orignal order asking the court that she be allowed to move because of her job and in this case i believe the court may give her the consent to move at least for the nine months she needs to get her companys benifits. You could make it easy on her and agree and ask that she move back at the end of the nine months and if she agrees then she can give you a statement stating so. The only other option would be that she allow you tempoy custody until she moves back. The court will make the final decition but you can always make it easy on yourselves by agreeing and workinh it out prior to her filing a motion with the court.
