If the grandparent has custody though the court then the mother or the father would have to file for custody back. Either one of the parents can file for custody. If the granparent does not have custody or guardianship though the court then they do not have it legally. The parent that has had the child live with them the last six months is usally the parent that would get custody. When there are changes though the court both parents should be notified.
