Custody

My boyfriend has custody of his son his exgirlfriend lives about twenty miles away and doesn't see him hardly. She has no custody rights how do I go about getting custody of him? also if something was to happen to my boyfriend what do I need to do now in order for him to not go live with her she is an unfit parent will a notarized letter stand up in court if I get him to sign it

She is also just on ssi and a lawyer told my boyfrien he could get a check off of him thru his mom but when we went to ssi in alabama they said we couln't can you explain this to me

You have know legal rights what soever in even trying to get custody nor visitations of the child. If anything were to happen to the father you would not have any legal right. If anything happens to the father and the mother cannot get custody of her child then it would be up to a family member to step in. If the mother is recieving SSI the lawyer is wrong if he said that the father could get any money for the child. however if the mother is recieving social security and has paid enought in over the years the child would be eligiable for some benifits. I will explain this to you, the difference between social security and SSI are that SSI is a form of welfare it comes in play when you can't get social security due to not working long enought to of earned enought to of paid into social security. This is not only the state of Alabama it is in all states. Hope i explained this for you.
