Do my ex-boyfriend and I share custody of my daughter?

I live in AZ. He is on the birth certificate.If we fight for custody will my criminal record be used against me?

It could be, if he wants to play dirty. However, you need to provide proof the child is well cared for an in a safe environment. Do you have a job, is the child in school, day care, does the child have regular medical visits? You might want to obtain feedback from close relatives as to your care of the child. If you can prove you are a good parent, and it is in the best interest of the child to live with you, you should not have a problem.

Well if the child is with you and you have never filed for custody or joint custody then you need to do so. He may be on the birth certificate but you were never married so being on the birth certificate would allow him visitations and to pay child support. Your crimmal back ground should have nothing to do with you getting custody of your child. The father would need alot of money to fight in court to try to get custody and as long as the child has been in your care and not his you should be fine. The law is that the parent that the child has resided with for the last 6 moths are usally the parent that would get custody and that is when your going though a divorce and have been married. It is alot harder to get custody from a mother from a father when he is just on the birth certificate. The only time your crimmal record would be of any great concern to the court is if you are or have ever been convicted for child abuse,or child molestation.

My ex-boyfriend and I have legal 50/50 custody right now. But legally my daughter is custody of her father due to we were not aloud to speak to one another because of a DV towards me was in progress that now has been dropped. I know that having it at 50/50 the parent who makes more money ends up paying the other parent child support which that would be me paying. I have not go one dime, diapers, clothes or anything from this man. I have a joural of all the time I have her since June 2009. He see's our daughter maybe 2-3 times a month for 4 hours. I have a trial date on Nov. 30, 2009 to change the custody for primary and have no attorney to help. What should I prepare myself for to win this case? This father also has no job by the way .

You need to contact legal aide and consult with an attorney, they go by income and can be found in the blue pages of your phone book under govrnmant. This is a custody battle and your chances of winning and changing the orignal custody order without an attorney is going to be differcult, as you stated before the judge would not allow you to talk to each other. If you do not perent your case right the court will dismiss it.
