Getting joint custody

I have a 4 month old child .the mother will not let me see her because i would not let her live with me. for one whole month i have not seen my child. ever since i found out she was my child , i wrote checks to her. when i call her to ask when i can see my child she tells me she dont know and that if i do see the child it will be under supervision. she tells me the only thing i need to be concerned about is putting the money in her account. as far as i know she has no job and no stable place to live. i think she stays with her parents but she will not tell me her location. the only reason i wont let her stay with me is because she is still married and i have no intentions on being with her . i just want to take care of my child. i spoke with a lawyer about getting joint custody and he told me i cant get it . someone please tell me why i cant get joint custody ? i reside in sc. and so does she

You cannot get joint custody because the mother is married and you were never married to her. It sounds like to me she is using you,and you need to look at this picture,she not only doesnot want you to see the child,she is asking you to deposit money into her account for child support,she must be in heaven,how do you know that her husband is not the father,and he could be on the childs birth certificate,being she is married I would asume he is. You would need to take a DNA test to prove parenty,and even then that would only mean you would not have to pay child support. You do not have to pay the mother any child support,until the court orders you to,and the mother would need to file a motion first asking the court to order support,I would not be paying any money to the mother until I had a DNA test done,or a court order making you pay. Do not give away your money to a woman that is married,and before having partenty established.

I had paternity establised but not through a hospital or dss .it was through a paternity test kit and the results say that the baby is mine. but i was also told those result are no good in child support court .and i would have to do it again. its been three weeks now . how long does it take to be served? she recently called me after all this time to ask me if iwant to see my child. she was supposed to bring the baby this past weekend and waited until sunday evening to tell me she cant bring the baby because she was feeling sick. that was her excuse. i think she is trying to make it look like she has been trying to let me see the child. but i still have not still

It is great that you took a partenty test, but it is true if you did not call the court house and get a list of court approved DNA agencys then the one you had done will not count. If you go though the courts and get this done and it is positive then you can file a motion with the court asking for visitations. If the mother has never filed for custody,then when you get your DNA test results file for joint custody, that will be the only way, if the court has already gave the mother custody then you will have to settle for visitations.
