The courts only allow for modivacation of the orignal custody order,if a custodial parent files to relocate out of state,then the non-custodial parent can counter suit for custody or if the non-custodial parent can prove to the court that he child is in danger by being with the custodial parent. This best thing for you to try to do is talk to the mother and see if she would allow you an extra evening, to work with your child,you can also cal the school and see if school offers any after school turtuing.

How can i get the child support order modified?
I currently have joint customer for my 6year old son with his mother. We were never married. I do pay child support and have scheduled visitation which consists of 1st, 3rd and 5th weekends plus 2hrs on Thursday. My child is in the 1st grade and failing. Per the teacher he is not turning in his homework on a consistent basis and failing on the majority of his work. When I attempted to speak with his mother regarding what we can do to correct this together...no resolution. How can I have the support order modified where I have more access to my child. I don't want to take him away from his mother but want to be more involved in his life. Can someone please help me?
