How do I go about changing my visitation rights?

I have a 4 year old daughter who lives in VA and I recently moved to Fla. Her mother wont let her come visit at all. We have joint custody. What do I need to do to get my visitation rights changed to where she cant say no? and do I need to do it in VA or can I do it in Fla?

Joint custody is fine when you are in the same state,when you decided to move then you lose the orignal visitation that was stipulated in the custody order, you would need to file a motion asking the court to modifly the orignal joint custody,and chance your visitations in order to take the child out of state. The mother does not have to allow you to take the child out of state. That cannot be enforced as part of the orignal order, until you file and get the court to change your visitation order,allowing you to take the child out of state for visits,you are stuck with not seeing the child. You can go online to courthouseinva.com and download the forms for modifling custody of minor child,and file with the court.

You will have to file in Virginia ( and you should have done that before you left). You will have to hire counsel in Virginia to represent you. You will have to modify the parenting plan and offer the new one to the court for approval. Since you are the non custodial parent and the party that moved, you will have to bear the cost of travel for the child. Make certain your include this in the parenting plan. Your attorney will know how to effort this change.
