In new york state can one parent visit children while other parent has custody in a 50/50 custody agreement

My friend has been divorced for over 3 yrs and lately her former husband has been showing up in the evening to say good nite to the children. She is not comfortable w/him being there but feels that since he is not harassing or hurting her in any way he can continue to do this. Does she have any leagle right to stop him. This is in New York State.

Well of course she does the visits should be set in the custody order and there for he should follow them. There is know reason for her to have to feel uncomforiable,maybe he is wanting to try to get back with her it is odd that he feels the need to just say goodnite to the children. I went though this with my ex and in the end it came out that he was wanting to get back together and there was not a chnace that would happen once he found that out he stopped coming by. But she just needs to tell him to follow the guidelines of the court order.
