JOINT CUSTODY ISSUES!

I have a 5 year old daughter. Me and her father never married, but she has his last name. I have tried to get child support for her a few years ago in Michigan, but unfortunately they couldnt find him. He is a ex convict in and out of prison, he just got released again recently, within the past 6 months, and he obtained a attorney to get joint custody of my daughter, we have been living in Alabama for the past year and a half and he currently resides in Michigan, he has only paid a total of 5 to 6 child support payments in her whole 5 years (in money orders, not court ordered), but we havent recieved anything in the past year, one of his convictions some years ago i recently found out was rape!, will he obtain joint custody of my 5 year old daughter?

Well because of his past record and not showing the court that he cares enought for the child to support her,you can ask the court that you want sole custody with linited visitations. They would understand your concern because of his life style and his crimmal record. If you do not go to court if he does try to file for custody then he could get custody. It is very imporant that you appear. You can also file a motion with the court before he does and make things easier on your self. I do not think you have to worry to much about his getting your daughter,the courts don't just take the kids from their mother. If he has an attorney to fight you in court he must of won the lotto because it will cost him alot of money by the hour as well as a retainer fee.
