Betsy, the laws vary from state to state on what age a child's choice is taken into consideration. Which state do you live in? I would start by contacting your county social services agency and talk with them. One thing you might also want to do is consult with a different attorney as you bring up some things that should definitely raise flags and give you an option for changing the custody arrangement. I know it's a long and tiring process but you're trying to do a good thing for you son.

My oldest son wants to come home to live with me his mother
I need help.My son will be 16 on the 20th of Feb.He wants to come home to live with me as his father is mentally abusing him and doesn't get him medical treatment when needed.My attorney has told me that my son doesn't have a right to choose who he wants to live with and I thought once you got to that certain age the child could choose whom he/she wanted to live with.I've been fighting with my ex husband for over 3 years now and I'm getting tired of fighting as he gets away with everything and I'm the one who has to get stuck paing for everything!!!!!! And I don't think it's fair to me or my children.

Just wanted to say thank you so much for your help.I never thought of calling the social services to find out what age it is to have the choice to move with the other parent.I will let you know what happens.And THANKS AGAIN you don't know what it means to me.
