Hi Brown838383; Is there a reason why your girlfriend did not get her green care renewed? I asume she got her green card to come to the states for school. The mother of your child could of within six months of her green card expiring applied to have it renewed. The most common reason for violation of Immigration Law is when an immigrant violates the law by staying in the country beyond the time limit of their visa (Green Card). When this happens then it is likely that removal proceeding will be initiated, as you have stated has already been initiated. I am not sure if you are wanting your girlfriend to stay in the states, or if you are both broke up and your wanting to know what your rights are regarding custody, visitation, ect. I am going to give you the name of two attorneys if you or your girlfriend want to contact them, in regards to the girlfriend needing repersentation to help her to not be deported, and for you to consult with for your legal rights with your child, because your child if born here in the states is a U.S. Citizen. Because you and the mother were never married, will make a difference on your legal rights, however if your on the childs birth certificate then you do have rights. What you need to do is talk with the mother and see what she wants to do, does she plan on trying to stay in the U.S. ?- If so she can contact one of these attorneys and try to get a temporary green card, there are many reasons that she may be able to get one, she can demostrate that her removal would result in extreme hardship to family members, as the child would benifit by being with both parents ect. The attorney would be the one to guide her in her options if she has any, not knowing the whole situration behind why she never renewed her green card I can only sujest she contact an attorney. Is the mother willing to let you have custod if she decides or cannot stay in the states? You said her mother lives here, being she has family here as well it maybe in the childs best interest to live in the states. This is a decition you both need to decide together, if she does not want her child to stay in the states, then you should consult with one of these attorneys to see what your rights are. I can tell you this if you are not listed on the childs birth certificate you will need to take a partenty test to establish that you are the father before you can file for any visitations ect.
