Someone please help us last resort.

My fiance was divorced almost 3 years ago joint custody was agreed upon with her having residential custody, almost three weeks ago now she moved to chicago and left the girls with him to live. They have started a new school are doing well and love it here. The ex wife informed him she would be back to get the kids in about 9 months mind you she still comes and visits them at least once a week. However, her intent is to move them to a new home, new school, and new city what can he do to prevent this from happening? He has contacted his lawyer and she informed him it would be very difficult if not impossible for him to get custody I find this hard to believe since she left them to live with him. The whole reason she left the children is because she lost her job which caused her to loose her appartment which resulted in her moving in with her mother and her mother in turn lost her home and his ex wife moved to chicago with her boyfriend. He needs help and we don't know what to do it is not in the best interest of the children to be shuffled from home to hom and school to school!

I believe you have a good case to get custody of the children you can file for custody at the court house they also have the forms on a web site i would talk to another lawyer try to find one that primary job is working for men. I just got temp of my kids and one of the reasons she has moved 9 times in the last 5 years.

The father needs to file for custody now while the children are in his care. The law is the parent that has the kids living with them the last 6 months are the parent that would be awarded custody. When you go to court tell the judge she dropped them at your door and now you want custody. The only way the mother may not lose custody is if you filed while they were in her care,this is different,the court is not going to just ignore that she left them and moved and their in school,the court looks at what is in the best interest of the children not the parent. Don't wait until she takes him to court the time is now for you to file while thier in your home.
