What to do when a child insist on changing who he lives with

The child is twelve he stays with me on the wekends and sometimes during the week. we have joint custody but she having primary guardianship. know the child has let it been known he wants to stay with me. this is afecting his school work and the teachers have said they can see a change in him for the worst.what can we do?

The child is 12 and although the court does listen to how the child feels he is a little young to make this decition for himself. You and your ex need to set a time to talk with the child and see why he feels this way. Because of his age the court will probary order counciling for him and you the parent that has physical custody and try to get them to work out any differences they may have that is leading the boy into feeling this way. If you both agree that he needs counciling then you can try this on your own and if you both feel that it is in the best interest of your son to stay with you the father then you can always try in on a trail basics. If you can;t work this out then you will have to let the court make the final decition. In this case don't take it for granted that the court will allow your son to make this decition he is a little young yet.
