Well I hate to be the one to give badnews, but if the mother left state without the consent of the fathe or the court then the father can be granted custody of the children. The mother should of filed forrelocation with the court. When the mother left the state without the consent of the father and court, the father has 96 days from the time the mother to file a motion with the court, so do not be surprized if he gets custody, what was the mother thinking, I have seen this over and over, and I can only figure they do nobelieve that the father will file charges against them, or file a motion with the court for custody, "Big Big" mistake.

Will the court reverse custody if a mother leaves states w/ kids under a split custody order?
My girlfriend has a split custody order for 2 kids. She is the primary resident for the children and has financially provided for them without the help of the father's short hand child support payments- which he now owes up to approx. $15,000. She worked full time and attended college classes online. Now she has moved out of state with the kids, enrolled the oldest in school, and living with her mother. The father has filed papers after 3 weeks of the move. The papers claim he is afraid the kids are in danger and that the mother has mental disorder (which she clearly does not). He wants full custody of the kids now. The mother is aware she will be in contempt for leaving state, but will the court order the children to come back to state of order with the father? Will she lose custody because she left the state with the kids?
