Leaving the State with my Child

I am in the military and I am being relocated and my ex husband is telling me that I can not leave the state with out his permission and that he will not give it to me. He is saying that he is not going to let me move my son out of the state of NJ. I have to relocate to VA as per my command. Please let me know if this is true and if so what can I do?

You divorce agreement should state the rules as to whether you can leave the state or not. Everyone's agreement is different depending upon their circumstances.

We aren't divorced yet...we don't even have the papers yet it was just decided a few days ago when he moved out. SO what should I do?

Because you are in the military, and have been restationed, they should be a little more leaniant on you. his opinion or stubbornness may be worth more if you just decided to leave. the military is your job, and that's how you make your money, so it's hard for them to tell you that you cant go. and if you are awarded custody then you would have to take the child with you. he would get to keep your son over the summer and every other holiday.

Depends, who has primary custody.

if you have sole custody, then you can do it. if it is a split/shared custody, then you will need to get that figured out before you move.

The government has ordered you to move along with your dependents (which would include him if you were to stay married). Therefore the child, according to the government, resides with you and is in your custody.

If your husband doesn't want you to take the child, then he will have to file a petition with the court to protest your child leaving the state. Since you aren't technically divorced, they will most likely reject his plea. So you are able to take the child out of the state and he will have to do the footwork to prevent you, but he is up against the government so good luck buddy!
